This is an article that appeared in a well known corporate board journal by an attorney who has a very important position in an extremely large and successful law firm. It is purported to be a response to the claims that corporations are not doing enough to remedy the ills of capitalism as defied by groups like BLM. It is well written but is also almost complete and utter nonsense. For example, it urges that corporations encourage better educational outcomes in urban schools by supporting pre-kindergarten programs, enhanced meals, after school activities and adopt a school programs. It is not up to corporations to do these things. Inner city schools around the country are usually pretty bad, but not because there is a lack of these programs. They are bad because enough parents don’t care, because teacher unions prevent firing of incompetent teachers and a thorough lack of sufficient competition with public schools. If corporations supported anything, it should be the dismantling of unions, increased number of charter schools and the institution of voucher programs. The job of corporations is to maximize long term value for its shareholders and do so by providing goods and services that customers want, hiring and retaining a competent workforce and do so by operating in compliance with applicable laws and regulations. Nothing else. Asking (requiring) corporations to be responsible for societal problems can only lead to greater government demands, oversight, regulations and fewer job and fewer successful companies.

Andrew McCarthy is a meticulous analyst and researcher who also writes exceedingly well and clearly. In this article, published in National Review, he takes us through the entire beginnings of the Russian/Trump collusion hoax. He shows it wasn’t Trump that colluded with the Russians to help his campaign; it was Clinton who actually colluded with the Russians to hurt his campaign. She had the assistance and support of elements in the State Department, the Intelligence agencies and the FBI. Covid Death Counts

The media reports over 200,000 Americans have died from Covid 19. However, how causes of deaths are recorded affects the actual number. The only number we know for sure is the total number of deaths, Causes are often complicated, so to isolate the effect of a pandemic, one needs to look at excess deaths, I,e. the number of people who died above what we would have expected. The author reports this number of excess deaths and disaggregates the number to Covid and to the lockdown separately. In the article, he has links to more detailed data, which is very informative. However, I could not transfer those links. You can see where they are as you read, but to actually link, you’ll need to go to the City Journal copy.

Biden Can’t Duck Trump’s Court

Dan Henninger is one of the best writers on the WSJ editorial staff. In this insightful article he lays out how Conservatives and Liberals take an entirely different approach to thinking about the purpose of the Court. The left wants it to decide based on their policy preferences; the right based on the law. I’m sure my characterization of these views would be challenged by the left, but they would be wrong.

Review of ‘Law and Leviathon”

Two Harvard professors – one from the left and one from the right -Cass R. Sunstein and Adrian Vermeule, wrote a defense of the Administrative State in Law and the Leviathan. Many Constitutional scholars have long argued that the administrative state has become too much of a legislative body and too divorced from both the people it affects and the public who votes. As the Supreme Court has found, in some cases, this has gone too far. In my opinion, the Court has deferred much to much to Administrative Agencies. Mr. White wrote this review of the book taking on directly the Sunstein/Vermeule argument. For those interested in this subject, its an interesting review and you might even want to understand the argument better by reading the book.

I found this email from a friend interesting. It purports to be an open letter to all Democrats from a Democrat. I cannot verify that assertion of authorship as true. I did not write this, but I wish I did. It needs to be shared. It addresses some of the questions about who to vote for as president next month and is in the form of a series of questions.
